Terms of Service

Last updated: 2026-10-23

1. Who we are and what these terms cover

These Terms of Service (the "Terms") are an agreement between you and Richburg Consulting, LLC, a North Carolina limited liability company ("we", "us"), for your use of AIV, our AI visibility measurement service, including the website, the client portal, reports and any related support (together, the "Service").

By creating an account, requesting a free Snapshot or paying for a plan, you agree to these Terms. If you use the Service for a business, you confirm you are authorized to bind that business, and "you" means the business.

2. What the Service is, and what it is not

AIV is a measurement service. We ask a fixed set of questions about your business to third-party AI assistants and search features, record what they answered, and report the results with the number of answers each figure is based on.

AI assistants are operated by other companies, and their answers can change at any time for reasons neither we nor you control. A report describes what the assistants answered when we asked; it does not predict future answers.

  • We do not guarantee that any assistant will mention, recommend or cite your business, or that any figure in a report will improve.
  • A report shows what assistants answered and what changed between measurements. It does not say why an answer changed, and we make no claim about why.
  • We are not affiliated with, endorsed by or acting for any AI assistant provider.

3. Accounts

You must give accurate information when you sign up and keep your sign-in details private. You are responsible for activity under your account. Tell us promptly at contact@richburgconsulting.com if you believe your account has been used without permission.

You must be at least 18 years old to use the Service.

4. Free Snapshot

A free Snapshot is limited to one per website domain in any 30-day period and covers a smaller set of assistants and questions than a paid plan. We may change or withdraw the free Snapshot at any time.

5. Estimates, prices and payment

Before you pay, the Service shows you an estimate based on your business and the number of questions your plan covers. The price you pay is the price shown at checkout. Prices are set by us and shown in U.S. dollars.

Payments are processed by Stripe. We do not receive or store your full card number. By paying you also agree to Stripe's terms for payment processing, published at https://stripe.com/legal.

If, once we have measured your business, the work fits a lower-priced plan than the one you paid for, we charge the lower price and refund the difference to your original payment method. We never charge more than the price you approved at checkout.

6. Monitor subscriptions and cancellation

Monitor is a monthly subscription. If you add Monitor when you buy a one-time report, the first Monitor charge is made one month after that purchase, and monthly after that, until you cancel.

You can cancel Monitor at any time by emailing contact@richburgconsulting.com. If you cancel before the first Monitor charge, you are not charged for Monitor. If you cancel later, cancellation takes effect at the end of the month already paid for, and that month is not refunded.

We may change Monitor's price for future months by telling you at least 30 days before the change takes effect.

7. Refunds

If you ask us to cancel a one-time report before measurement has started, we refund that payment in full. Because a report is produced from measurements we pay for when we run them, one-time reports are not refundable once measurement has started, except as described in section 5 or where the law requires. If we cannot deliver a report you paid for, we refund that payment in full.

8. Your information and your business data

You keep ownership of the information you give us about your business. You give us permission to use it to provide the Service, including sending questions about your business to AI assistants.

How we collect, use, share and keep personal information is described in our Privacy page, which forms part of these Terms.

We never sell your information or your business data. We may use measurements to describe and improve the Service only in aggregated form that combines at least 10 businesses and does not identify you or your business.

9. Reports and acceptable use

You may use, share and publish your reports for your own business. If you quote a figure from a report, quote it with the number of answers it is based on and the date it was measured.

  • Do not use the Service to measure a business you do not own or represent, unless you are an agency acting with that business's permission.
  • Do not attempt to access another customer's data, overload the Service, or copy the Service to build a competing product.
  • Do not present a report as an endorsement by any AI assistant provider.

10. Agencies and white-labeled reports

If you are an agency using the Service for your own clients, you are responsible for having your clients' permission, for the accuracy of what you tell them about the Service, and for your own agreement with them. Agency use is also governed by a separate agency agreement between you and us. Where that agreement and these Terms conflict, the agency agreement controls.

11. Disclaimers

The Service and every report are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant the accuracy, completeness or availability of any third-party AI assistant or search feature.

Nothing in these Terms excludes or limits any warranty or right that the law does not allow to be excluded or limited.

12. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or revenue. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim arose.

These limits do not apply to liability for our fraud, gross negligence or willful misconduct, to the refunds these Terms promise, or to any liability that the law does not allow to be limited.

13. Suspension and termination

You may stop using the Service and close your account at any time by contacting us. We may suspend or end your access if you break these Terms, if a payment fails and is not resolved, or if we stop offering the Service, and where practical we will tell you first.

When your account ends, sections 7, 8, 11, 12, 14 and 15 continue to apply. What happens to your data after your account ends is described in the Privacy page.

14. Governing law and disputes

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules.

Any dispute relating to these Terms or the Service will be decided by the state or federal courts located in Mecklenburg County, North Carolina, and you and we agree to their jurisdiction. These Terms do not require arbitration and do not waive your right to bring or take part in a class action.

15. Changes to these terms and contact

We may update these Terms. If a change is material, we will tell you by email or in the portal before it takes effect. The date at the top of this page shows when the Terms last changed.
